What XD Says
XD’s End User License Agreement, last updated November 16, 2021, is the contract behind Torchlight: Infinite. Section 2.3 grants a personal, limited, “non-commercial, non-transferable” licence, section 2.4 says users shall not sell XD services, games or contents, and section 4.2 bars exploiting XD services for any commercial purpose. Section 6.3 adds the penalty: XD may suspend or terminate access and the agreement itself if a user materially breaches it. A paid Flame Elementium order is a commercial sale of game content, so it sits outside that licence even when the handover uses a normal in-game screen.
The Torchlight team has also described designing the game against this market. In its Crows Corner community FAQ of June 14, 2023, XD said world-chat restrictions exist mainly to prevent RMT spam, and answered a request for face-to-face trading by saying there were no plans for it, because it may encourage real-money trading and complicate monitoring. The one transfer route the game does offer — the Trade House — was kept deliberately monitorable.
How Delivery Works: the Trade House Only
Flame Elementium cannot simply be handed over. Sellers describe it as account-bound, with no direct player-to-player trade window, so every third-party order is routed through the Trade House, which unlocks at level 60. The standard routine, set out by MmoGah and CNL Gaming, is that you list a specific item — sellers usually ask for a Pedigree of Gods legendary slate, chosen because its rolls make your listing easy to identify — at exactly the agreed Flame Elementium price, then send the seller a screenshot showing the item, its stats, the price and your character name. The seller finds and buys that listing, and the Elementium reaches you as the sale proceeds.
Two costs are built into that routine. A new listing can take about 30 to 60 minutes to become searchable, so “instant” delivery is not instant. And the Trade House taxes sale proceeds: XD’s Dev Blog #25 introduced a phased transaction tax after Season 1, with an opening amount of Flame Elementium exempt and a heavier rate once seasonal sales pass 10,000 of one currency; seller pages warn that they do not cover the tax. Agree in writing, before you list, whether the price you set is the amount you receive or the amount before tax.
What it pays for, briefly: Flame Elementium is the Trade House’s main pricing currency and the top crafting material, used at the Arms Dealer on five- and six-affix gear, and it only starts dropping in Netherrealm maps from Tier 4 upward (CNL Gaming). Season and standard servers are separate economies, and Elementium bought for one cannot be used on the other.
What Can Go Wrong
- Suspension or termination. XD’s EULA section 6.3 allows it to suspend or terminate access for a material breach, and a delivery is an unusually visible breach: one low-value item sold for a very large, round sum of Flame Elementium.
- A tax shortfall. If the seller does not cover Trade House tax, you receive less Elementium than you paid for, and the difference grows on large orders once the seasonal exemption is used up.
- The wrong listing gets bought, or yours is missed. Delivery depends on the seller identifying your exact item from a screenshot during a 30 to 60 minute visibility window; a similar Pedigree of Gods or a mistyped price can send the money elsewhere.
- The wrong economy. Season and standard servers do not share Elementium, so an order placed for the wrong one is worthless to the character you actually play.
- No publisher help. Because the purchase itself breaks XD’s terms, a failed delivery is a dispute with the seller and your payment provider, not something XD support can be asked to put right.
Red Flags to Avoid
- Any seller who asks for your XD, TapTap, Steam or email login, password or verification code: Trade House delivery needs a listing and a screenshot, never account access.
- An offer of direct, face-to-face or mail delivery of Flame Elementium: the game has no such transfer, and XD has said it has no plans to add face-to-face trading.
- Prices far below other sellers early in a season, when Elementium is scarcest and legitimate supply is thinnest.
- A seller who will not confirm the season, server and tax treatment in writing before you list your item.
- Payment only by crypto, gift cards or bank transfer, with no refund if the listing is never bought.
If You Decide to Go Ahead
We can’t make a purchase allowed by XD’s EULA. If you still buy, confirm the season and server, the exact item to list, the price and who covers the Trade House tax in writing first, use a marketplace with buyer protection, never share your login, pay with a method you can dispute, and keep the screenshot and order records. Lower-Risk Alternatives
Earn Flame Elementium the way the economy expects: run Netherrealm maps from Tier 4 upward, where it begins to drop, and sell spare legendaries, materials and other loot through the Trade House once you reach level 60. If you want to spend real money, the official purchase is Primocryst — the Arc Games storefront lists packs from 60 Primocryst for $0.99 to 6,480 for $99.99 — but be clear about what it buys. Producer Liu Heng told GameSpot that XD would not sell gear or crafting materials for real money, calling them “strictly grind-to-get”; Primocryst buys convenience, heroes and cosmetics, not Flame Elementium.
